Who we are

Mind Over Market is sold by Mind Over Market, [[BUSINESS ADDRESS]], [[COUNTRY]] (“we”, “us”). You can reach us at mindovermarketservice@gmail.com.

The product

Mind Over Market is a digital trading journal delivered as a personal file (an HTML file you open in your web browser). It lets you record trades, checks and reviews and view your own statistics. It is software for record-keeping and self-review only.

The product is described on this website. Screenshots use sample data and are for illustration. Minor visual differences may exist between screenshots and the version delivered.

Your order and delivery

When you complete checkout, your payment provider confirms the payment to us and we e-mail your personal file to the e-mail address you entered at checkout. This normally takes a few minutes. Please check your spam folder and make sure you entered your address correctly. If the file has not arrived within 24 hours, contact mindovermarketservice@gmail.com and we will resend it.

The contract is formed when your payment is accepted. Delivery is complete when the e-mail with your file is sent.

Price and payment

The price is shown in US dollars (USD) at checkout and is a one-time payment, not a subscription. Where the law requires it, applicable sales tax or VAT is added or included at checkout. Payments are processed securely by Stripe, Inc. and its partners. We do not see or store your card number. Apple Pay and Google Pay are offered by Stripe where your device and browser support them.

A “regular price” shown crossed out on the website is the price at which we list the product outside the current offer. We may change prices at any time; a change does not affect orders already placed.

Licence

When you buy, we grant you a personal, non-exclusive, non-transferable, non-sublicensable licence to use your personal copy for your own trading journal, on any devices you own or control.

You may not: (a) resell, share, publish or give away your file or its licence code; (b) remove licence or copyright notices; (c) reverse-engineer the product to build a competing product for sale; or (d) use the product unlawfully. We may end the licence of a file that is shared or resold in breach of these terms and take the steps the law allows.

Your data stays with you

Your journal entries are stored only in your own web browser, on your own device. We do not receive, host or have access to them. This means you are responsible for keeping a backup (the product includes an export and restore function). If you clear your browser data, use a different browser or lose your device without a backup, your entries may be lost and we cannot recover them.

Refunds and your rights

Our refund terms are set out in the Refund Policy. They apply in addition to, and do not limit, any rights you have by law as a consumer.

No financial advice

Nothing in the product or on this website is financial, investment, legal or tax advice, a recommendation or a solicitation. Trading carries a high risk of loss. You alone are responsible for your trading decisions. See the Risk Disclaimer.

Warranty

We provide the product with reasonable care and skill. Software can contain errors and we do not promise that it will be uninterrupted or error-free or that it will fit every purpose or every browser. Where the law gives you rights that cannot be excluded, such as the right to digital content that is of satisfactory quality and as described, these terms do not affect them.

Limitation of liability

To the fullest extent the law allows, we are not liable for trading losses, lost profits, lost data or indirect or consequential damage arising from your use of the product, and our total liability for any claim relating to the product is limited to the price you paid for it. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or for gross negligence or wilful misconduct.

Intellectual property

The product, its design, text and code are owned by us or our licensors and are protected by copyright. Your licence does not transfer any ownership. You own the content you enter into your journal.

Changes to these terms

We may update these terms. The version published on this website at the time of your order applies to that order. Material changes will show a new “last updated” date.

Governing law and disputes

These terms are governed by [[GOVERNING LAW AND COURTS, e.g. the laws of the State of Israel]]. If you are a consumer, you also keep the protection of the mandatory consumer laws of the country where you live, and you may bring a claim in the courts of that country. If you are in the EU you can also use the European Commission’s online dispute resolution platform. We are happy to try to settle any problem directly first. Please write to mindovermarketservice@gmail.com.
